What is the FMCSA Drug & Alcohol Clearinghouse
The FMCSA Drug & Alcohol Clearinghouse is a secure online database that provides real-time information about CDL drivers' drug and alcohol program violations. Launched January 6, 2020, it contains records of positive drug or alcohol test results, test refusals, and completion of return-to-duty processes. All FMCSA-regulated employers must query the Clearinghouse for current and prospective employees before allowing them to operate commercial motor vehicles.
How often must employers query the Clearinghouse
Employers must conduct full queries for all new hires before they begin safety-sensitive functions, and limited queries on all current CDL drivers at least once annually. According to FMCSA regulations, employers must obtain electronic consent from drivers for full queries, but limited queries can be conducted without driver consent.
What types of DOT drug testing are required
FMCSA requires five types of drug testing under 49 CFR Part 382:
Pre-employment testing - Required before first safety-sensitive duty
Random testing - Minimum 50% of drivers annually for drugs, 10% for alcohol
Post-accident testing - Required after fatal accidents or when citations are issued
Reasonable suspicion testing - When trained supervisors suspect impairment
Return-to-duty and follow-up testing - After violations
What is a SAP and when is one needed
A Substance Abuse Professional (SAP) is a licensed professional who evaluates employees after DOT drug and alcohol violations. According to DOT regulations, any driver who tests positive, refuses a test, or violates other drug/alcohol prohibitions must complete the SAP return-to-duty process before performing safety-sensitive functions. Do owner-operators need to join a consortium for random testing
Yes. According to FMCSA regulations, owner-operators who employ only themselves and are not leased to a motor carrier must join a consortium with at least two covered employees in the random testing pool. This requirement ensures compliance with DOT's random testing mandates.
Can drivers work while waiting for drug test results
It depends on the test type. According to FMCSA guidance, pre-employment testing requires negative results before the driver can begin safety-sensitive functions. However, drivers who take random or post-accident tests may continue driving while results are being processed, unless the test was conducted for reasonable suspicion.
How much do Clearinghouse queries cost
