Previous-Employer Safety History: What to Check
“Safety history” means checking a prospective driver’s relevant work with prior DOT-regulated employers—not just collecting a signature on a release. Keep accident and employment-history inquiries separate from the drug-and-alcohol Clearinghouse step so each record is obtained through the right route.
Previous-employer safety history
Under 49 CFR § 391.23, a motor carrier investigates a driver’s safety performance history with DOT-regulated employers from the preceding three years. For prior employers that used the driver to operate a CMV, the inquiry includes employment verification and specified accident information. Record each contact attempt and response; the rule addresses what to document when an employer does not respond or no prior DOT-regulated employment exists. The investigation response or documented good-faith effort belongs in the driver investigation history file within the rule’s 30-day window.
Drug-and-alcohol history is a separate check
Since January 6, 2023, an employer subject to the FMCSA Clearinghouse pre-employment query rule must use the Clearinghouse for violation history from previous FMCSA-regulated employers; a mailed questionnaire does not replace that query. If the driver worked in a safety-sensitive role under another DOT mode, direct inquiries may still be required because those records are not in the FMCSA Clearinghouse. The rule also has a separate route for an incomplete follow-up testing plan. Check which situation applies before using a release.
What to keep
Keep the prior-employer requests, responses, documented good-faith attempts, and any required driver notice or correction/rebuttal record in the appropriate restricted driver history file. Use a secure employer-approved channel for records containing driver identifiers, accidents, or testing history—not a general public contact form or marketing email. If you need help organizing your own driver records, start with LBC Fleet’s DQ-file management service or its broader compliance-services directory; neither replaces the carrier’s decision about what inquiries apply.
About the older LBC PDF: The 2020 “Previous Employer Safety Check” form asks for an SSN and routes testing history through a manual previous-employer questionnaire. Because the federal process changed in 2023, this page does not present that PDF as a current ready-to-send form. Build the request from today’s rules and your approved secure workflow.
